Course content

The internal market is of fundamental importance to the EU, which would not exist without it.    So every student of EU law needs to know about it.

The course covers the scope and content of the 4 freedoms - and especially the free movement of goods - which form the internal market, and the exceptions to these freedoms.

As to the latter, we will focus particularly on the public health exception, as it is the most important and there have been some significant recent judgments.

Objectives (and/or specific learning outcomes)

Acquisition of a thorough knowledge of the principles governing the internal market and the free movement of goods in particular.

Teaching methods and learning activities

In so far as possible, all classes will take place physically in the Institut d'Etudes Européennes.

Socratic method. Students are strongly encouraged to be active in class, whether they are attending classes in person or online. Since students from some countries have no experience of answering problems ( cas pratiques ) in exams, the last class will be devoted to a discussion of some problems posed in previous exams.

The moot is quite separate from the EU-wide moot in which some of the students take part.  In this course, students have to prepare it in teams. As from January, Mr. Martinez will be available to assist the students in preparing the moot.

Students are required to read all the judgments marked with an asterisk on the hand-outs. All the other required reading is reproduced on the website.

As mentioned about, the course will be held physically in the Institut d'Etudes européennes, as far as possible.

There are 2 exams: ( i ) a written exam in mid-January and ( ii ) a moot in late April / early May.  The written exam will consist of several problems (cas pratiques) and will be open-book.


As mentioned above, we will do our very best to hold the moot, even if it can only be done online.

Mark calculation method (including weighting of intermediary marks)

Each student's final mark will be the average of his marks in the two parts of the exam.
