Droit de l'économie durable

The “Droit de l’économie durable” course aims to provide an in-depth analysis of the emergence of a new field of economic law focused on the sustainability of business activities. At the intersection of corporate law, financial law, employment law, tax law, and tort law, and incorporating elements of European law, sustainable economy law reflects the transformation of the role of the company, which is now regarded as an actor that is legally responsible for the impacts of its activities in light of environmental, social, and governance criteria.

The course examines how the law seeks to ensure that companies take into account objectives of general interest, such as the protection of human rights and the preservation of the environment. It also addresses the implications of these regulatory developments for corporate governance and their impact on the way companies operate.

Particular attention is given to the structuring role played by the European Union in this normative development.

The “Droit de l’économie durable” course seeks to enable students to develop a critical perspective that will allow them to assess the effectiveness of legal instruments aimed at promoting economic sustainability, as well as their actual capacity to transform economic practices.

More broadly, through the study of European texts, national legislation, judicial decisions, and practical case studies, this course aims to equip students with the tools necessary to understand and support the transformation of economic law towards a sustainability-oriented model.

Except for the introductory and concluding sessions, each class will begin with a presentation by a group of students on the topic covered during that class.

A number of the lectures will be delivered ex cathedra. Some sessions will take the form of a “flipped classroom”. This teaching method is designed to enable students to gain a thorough understanding of certain aspects of the subject by working on practical cases or engaging with assigned readings, which will then be explained in a structured manner after students have attempted to solve the cases and analyze the readings individually or in small groups. In addition to fostering more dynamic learning, autonomy, and collaboration, the examination of these practical cases and readings will provide an opportunity for debate on key issues in sustainable economy law.

At the end of each session, students will be asked a few questions via the Wooclap application to ensure that they have understood the material and to encourage interaction. The format of these questions will be similar to that of the questions included in the final examination.

Slides outlining the key elements (structure, legal provisions, etc.) of the topics covered will be made available to students during the course and on the website “Université virtuelle”. In addition, students will be provided with a course pack containing case law decisions and legal scholarship.

Oral presentation

The grade awarded to students will be based, on the one hand, on an assessment of their oral presentations on the topics covered (25% of the final grade) and, on the other hand, on an assessment based on a written examination (75% of the final grade).

The assessment of the presentations will be based on three criteria: the mastery of the subject matter, the structure and coherence of the reasoning, and the quality of the oral presentation.

As regards the written examination, it will take the form of a true-or-false test requiring justification. Students will be presented with five statements and will have to determine whether each statement is true or false and justify their answer by drawing on the legal arguments discussed during the different course sessions.

The assessment method is the same for both the first and second examination sessions.
