Internal Market

The course offers a comprehensive and operational exploration of the law of the internal market.

It is articulated around three main parts. The first focuses on the political and economic foundations of the internal market as a project and objective of the European Union, and on the main integration techniques through which it can be realised. The second examines the four freedoms which constitute the internal market (goods, services, capital and persons). The emphasis is placed on the transversal principles and rules which govern these freedoms and the exceptions to which they can be subjected. The third part of the course is devoted to contemporary issues of internal market law.

The main objective of the course is to give students a solid knowledge of the principles and doctrines which govern the internal market and the four freedoms. Students should also be able to mobilise these rules and principles in concrete, real-life situations.

Students will also be encouraged to think critically about the internal market and its law, their limitations and their social, economic and political ramifications.

Connaissances et compétences pré-requises ou co-requises

Students are expected to have followed a general introductory course of European Union Law.

The course will be taught in English, and students are expected to have an acceptable command of the English language (both in its passive and active dimensions).

The course will be taught in an interactive manner and the teacher will encourage student participation. Sessions will combine lecture-style presentations and interactive moments, based on the preparatory readings students will be requested to do before each session, on the basis of a number of structuring questions. Relevant documents (legislation, case-law, doctrinal contributions) with be placed online on the Université viturelle.

This approach, which is directly inspired by the socratic method used in anglo-saxon universities, seeks to empower students, and encourages them to own and critically approach the substance covered by the course. It is particularly suitable for a course taught at Master level, which seeks to further explore a topic to which students have already been introduced.

20% of the final grade is based on student in-class participation. The remaining 80% is based on a written examen, taken at the end of the course.

The exam comprises three categories of questions : (i) short questions, designed to test the knowledge of the students ; (ii) an open question, designed to test the students’ ability to critically reflect about the legal contents analysed by the course ; (iii) a practical case designed to test the students’ ability to mobilise and apply the legal contents covered by the course in a real-life situation.
